DISPUTE
A dispute is a conflict between the two or more parties; the word dispute has a wide meaning in terms of the law. Although the word dispute has not been defined anywhere in the laws which have been framed and implemented and which will be framed and implemented are totally on the basis of the dispute.
In India, or under Indian Law, there are various types of dispute, which is resolved or the resolution of the dispute is being governed under various code and various act. Although the judicial body has also laid down the other mechanism to resolve a dispute in order to attain speedy disposal of the case. The Dispute in India is either being resolved through litigation or through other dispute resolution mechanism.
Here are the few instances and derivatives of the word dispute
TRANSACTIONAL DISPUTE:
Any dispute arose between the parties through a transaction, is called transactional dispute, to resolve this dispute the procedure will be governed under civil procedure code, until and unless the procedure has been specifically laid down in any other statute with regard to a specific transaction
PROPERTY DISPUTE:
The dispute arose between the properties, either due to transaction in relation to the property, or dispute arose with regard to possession or transfer of property, such dispute is known as a property dispute. The filing of claim shall be done in accordance with the procedure laid down in the Civil Procedure Code, Specific Relief Act and Transfer of Property Act.
BANKING DISPUTE:
The Dispute arose from loan transaction between the alleged defaulter and the bank is called Banking Dispute. This dispute can be with regard to a loan default, or failure of paying EMI by the Customer or with regard to possession of security property by Bank. Such type of dispute will be resolved under order 37 of the civil procedure code, before Civil Court or under Sarfesi Act before Debt Recovery Tribunal, depending upon facts and circumstances of the case.
CONSUMER DISPUTE
The conflict between the consumer and the manufacturer, or between the consumer and the dealer, is known as the consumer dispute. Such dispute is being resolved under law laid down in the consumer protection act.
COMPANY DISPUTE:
The dispute arose between the companies or within the officials of a company are known as company dispute. This dispute can be related to a dispute between employer and employee or with regard to transaction took place between the two companies. The Dispute on the basis of such conflict will be resolved either under Companies Act or under Insolvency and Bankruptcy code, before National Company Law Tribunal.
FAMILY DISPUTE:
A family dispute is a dispute which takes place either between the husband and wife or between the wife and family members of a husband or the conflict within the family members with regard to succession of the property. The resolution of such conflict which arose within the family is governed under personal laws of the particular religion, Domestic Violence and even under the Indian Penal Code & Criminal Procedure Code.
