Consumer Protection Act, 2019
The pecuniary jurisdiction of all three commissions, district, state, and national, formerly called forums, has increased to Rs 10 crores and more monetary-related cases. The district commission would deal withcases under the monetary value of 1 crore. The State Commission would handle the disputes falling under the monetary value of 1 crore to 10 crore. This would be dealt with at the national level, cases that involved an economic value of 10 crores and beyond. For the first time, all three commissions had the power to review. They can review their judgments.
Before the enactment of the new Consumer Protection Act 2020, what used to happen was that if there was some error apparent on the face of the record by the district forum, then the dispute reached the state forum consistently and constantly without having a review of the same decision by the same court to save time and energy of the judicial system at the state level. As if now, the mistake can be corrected by the decision-making bodies themselves through the process of reviewing their own passed verdict.
More than half of the suits and complaints are preferred and suggested initially to be resolved in the mediation structure of the dispute resolution mechanism as many parties also feel and prefer the method which is feasible and inherent quick matter disposition in itself instead of spending more time, investing more money and energy and taking the dispute inside the court where the guaranteed fair justice is absent and also becomes a long-term deal. The mediation process is equally beneficial for the complainant and the respondents as it supports neither of the sides, and both opt for fair and just means of dispute resolution by engaging in a peaceful negotiated discussion.
The currently followed act of 2019, the Consumer Protection Act, mentions a definition of recall and has a specific provision embracing its importance in the present scenario. The product recall provision was lacking in the former Act because, at that time, there was a need to recall and review the product as cases regarding the selling of hazardous and defective products were coming up. These products were being sold and manufactured without anybody having any check on the quality of the same before they entered into the retail or wholesale marketplace for consumption purposes and not further sale or transportation of the product. But so far, the product can be recalled in part or completely, meaning that the product can be examined well even if it has passed the manufacturing stage or has reached the market.
Instead, certain landmark judgments of the National Commission can be traced well from the past. The Maggie noodle ban case was a one-acted case in the year 2015 where the Nestle company came opposite to the judgment of the court, which implemented a fine of Rs. 20 lakhs on the company for producing and selling harmful products in the market. After this incident, the Nestle company filed an appeal to the court, challenged the court order, and refuted the allegations framed and placed on the company, which seemed defamatory and insulting. In this case, the court also recalled the product for proper checking. The Maggie noodle case turned out to be a highly significant and path-breaking case concerning the safety and security of consumers, wherein the court noted that some much-needed provisions were absent in the older Act and must be incorporated immediately. The judgements of the leading light clarified the need for the provision of recalling, which was adopted later on. They were permanently codified in the new Consumer Protection Act.
