A lawyer with Bipolar Disorder set to be a judge - SC

 

The Top Court upheld a judgment that called for the appointment of Bhavya Nain as a judicial officer after he was rejected on the ground of Bipolar Affective Disorder (BPAD). 

 

The medical board set up on the directions of the SC had found nothing to indicate that he would not be able to carry out his commitments as a judicial officer.

 

Bhavya Nain was first diagnosed with BPAD in 2010. He applied for judicial services in 2018 and cleared all stages of the process. However, his candidature was rejected on the ground that his disability was not as per his disability certificate .i.e. it was not found permanent as per the certificate. 

 

Bhavya challenged the rejection before the Delhi HC. the Court directed his selection in the judicial services and held that a person with a disability cannot be discriminated against in matters related to employment.

 

The Supreme Court upheld the same.
