Accept that J&K Is India's Integral Part: SC Requests Affidavit From MP

The Supreme Court has taken a significant step in the ongoing challenge to the abrogation of Article 370, instructing Lok Sabha MP Akbar Lone, one of the petitioners, to provide an affidavit affirming his allegiance to the Indian Constitution and unequivocally asserting that Jammu and Kashmir is an integral part of India. This development occurred during a hearing conducted by a Constitution Bench headed by Chief Justice of India DY Chandrachud.

The court's decision was prompted by revelations made by Solicitor General Tushar Mehta, who disclosed that Lone had previously chanted "Pakistan Zindabad" (Long Live Pakistan) in a public gathering. Mehta further requested that Lone explicitly express his opposition to terrorism and secessionism.

This demand was supported by Attorney General R Venkataramani, who highlighted the contradiction in Lone's stance: seeking the enforcement of his fundamental rights while also delivering speeches in support of terrorism and secessionism.

Chief Justice Chandrachud stressed the importance of Lone's allegiance to the Constitution, considering his approach to the court under Article 32. He stated that Lone must acknowledge the nation's sovereignty and recognize Jammu and Kashmir as an integral part of India. As a result, the court insisted on Lone submitting an affidavit that explicitly confirms these principles.

This development underscores the significance of upholding the principles of the Indian Constitution and reinforcing the unity of the nation, particularly in the context of Article 370's abrogation and its legal challenges.
