ALLAHABAD HIGH COURT TO UP GOVERNMENT

The Lucknow bench has asked the state government to form administrative guidelines and submit the same before the court in order to avoid incidents such as the late night cremation of the Hathras victim. The bench on Tuesday was not satisfied with explanations of the administration on the victim’s body which was not handed over to the family for last rites and further the cremation was held late in the night.
The High Court further directed that the Government should come out with appropriate procedures as guidance for district officials to deal with such situations.
Moreover, The Hon’ble High Court held that the Hathras victim’s fundamental right to a decent cremation was infringed upon by authorities when they cremated her in the middle of the night without letting her family perform their rituals.
The Hon’ble High Court concluded action of hurried cremation by the state authorities, though in the name of law and order situation, is prima facie an infringement upon the human rights of the victim and her family.
