BAIL GRANTED BY THE ALLAHABAD HIGH COURT TO A PERSON BOOKED UNDER SUSPICION OF COW SLAUGHTER
The Allahabad High Court has granted bail to Suraj, a primary accused of the case Suraj vs the State of UP, arrested on the basis of an alleged conversation that was overheard by police personnel.
Suraj and three other people were arrested by the police under the Uttar Pradesh Prevention of Cow Slaughter Act, 1955. The court observed that the FIR was registered merely based on a conversation between the parties and lacked evidence to prove the same.
As claimed by the Police Authorities, the accused was planning to slaughter two bulls and make a huge amount of money out of it. It was further alleged that a bundle of rope, one hammer, two Ghadasas (big and small), one nail and twelve empty packets of 5 kg were also recovered from their possession. However, from the perusal of the FIR, it was evident that neither of the bulls which were found in possession of the accused had been slaughtered nor were maimed or had any physical injury.
A single-judge bench of Justice Abdul Moin granted bail to the accused, declaring that the application was made on frivolous grounds as there is no evidence to support the claim. The Court further asked the Superintendent of Police, Sitapur, to submit a personal affidavit explaining all the invoked charges as claimed against the applicant.
