Mumbai's special court, while passing the death sentence to a 45-year-old man for brutally raping and killing a woman, said that the heinous crime has brought down the dignity of Mumbai.
The special court, designated to hear cases under the POCSO Act, was considering a case filed against Mohan Chauhan, a resident of Uttar Pradesh state, who in September, last year, was booked by the Mumbai Police for raping a woman belonging to the Scheduled Caste.
As per the case, the accused, having two daughters and a son, raped the woman in a tempo in Mumbai's Saki Naka area. He inserted a weapon in her private parts and pulled out her intestines, which ultimately led to her death. He was convicted of rape, murder, and other relevant provisions of the SC-ST (Prevention of Atrocities) Act.
The judge said that the incident wasn't only the murder of the woman but even her dignity. The noted that by far, 37 witnesses proved its case beyond reasonable doubt along with the forensic reports. Before awarding the death sentence, the Judge took note of the aggravating as well as the mitigating factors and concluded that the former outweighed the latter. The Court further also noted that the accused had expressed no repentance after committing the crime.
Chauhan is charged with rape, murder, and other relevant provisions of the Bombay Police Act and the SC-ST (Prevention of Atrocities) Act.
