Case: Srishti Madurai Educational Research Foundation v Govt of NCT of Delhi and Ors

Bench: A division bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad

The Delhi High Court has given the Delhi government eight weeks to decide on the Delhi Commission for Protection of Child Rights (DCPCR)'s recommendations on the ban of sex-selective surgeries on intersex infants and kids except in life-threatening situations. The term intersex infant refers to children born with both male and female sex organs.

The bench passed the directions while disposing of a PIL by an NGO, Srishti Madurai Educational Research Foundation. The petitioner requested the bench to issue guidelines on the conditions and when medical surgery on intersex infants and children can be performed.

It was claimed that the DCPCR submitted a detailed report to the Delhi government on the issue, however, the government did not take a decision.

Counsel appearing for the State sought time to take decisions on the issue.

The bench gave the eight weeks to the State and disposed of the plea.
