DELHI HC ALLOWED THE RELEASE OF JAYESHBHAI JORDAAR AFTER PRODUCERS AGREED TO ADD A DISCLAIMER REGARDING FEMALE INFANTICIDE

Recently, the Delhi High Court allowed the release of Ranveer Singh's Jayeshbhai Jordaar after Yash Raj Films agreed to have disclaimers in scenes depicting pregnant women getting ultrasounds. The bench directed the producers to include a disclaimer that female infanticide is a punishable offense at the references made in the film regarding the sex of an unborn child.
FACTS
The bench was considering a Public Interest Litigation (PIL) filed by Youth Against Crime, an NGO. Advocate Pawan Prakash Pathak appearing for the petitioner demanded that a scene showing the clinic determining the sex of the unborn child should be removed.
Advocate Pathak argued that though the movie is based aims to promote awareness on saving girl children, its trailer advertises the use of ultrasound for sex determination, which is prohibited under the Pre-Conception and Pre-Natal Diagnostic Techniques (PCPNDT) Act, 1994.

After watching the trailer and a few clips of the movie, the bench observed that the film was against female foeticide. However, the bench suggested that a disclaimer should be given in the trailers and the scene in question.
