Delhi HC: Probe Initiated into Allegations of Expired Food Products Being Sold
The Delhi High Court has issued a directive to the Delhi Police Crime Branch to conduct an extensive investigation into the reported case of re-packaging and sale of expired food products in the city. The order, accessed by our sources, emphasized the need for a detailed inquiry into the coordinated and systematic reintroduction of expired goods into the market.
Justice Prathibha M Singh, presiding over the case filed by renowned chocolate brand Hershey’s, expressed concern over the alleged purchase of expired products by unscrupulous individuals, who manipulate manufacturing and expiry dates before reintroducing them into the commerce stream. The court noted that this practice poses serious threats to food safety and public health.
In a recent 14-page order, Justice Singh directed the matter to be brought before Acting Chief Justice Manmohan for further judicial consideration. Stressing the importance of prioritizing food safety and public health, the court-mandated a thorough investigation by the Delhi Police Crime Branch.
Hershey’s, in its complaint, sought an immediate stay against Akshat Online Traders (AOT), accusing the company of selling expired chocolates by re-packaging them. The court acknowledged Hershey’s concerns, describing AOT as a "rank counterfeiter" causing harm to both Hershey’s and the public. The court also ordered two Food Safety and Standards Authority of India (FSSAI) inspectors to accompany local commissioners for an in-depth inspection and testing of all products sold by AOT, considering the urgency and seriousness of the allegations.
