BENCH: Division Bench of Acting Chief Justice Vipin Sanghi and Justice Jasmeet Singh

The Delhi High Court allowed two petitions challenging the Delhi Government's Mukhya Mantri Ghar Ghar Ration Yojana (MMGGRY) by striking down the scheme for doorstep delivery of rations in Delhi. A bench said that the scheme was not approved by the Lieutenant Government (LG) and, therefore, the same cannot be implemented.

The bench held that the State Government is authorised to frame a scheme for doorstep delivery of rations to the beneficiaries under the Targeted Public Distribution System (TPDS). However, the same has to be done by the government from its resources. The Chief Minister is bound to communicate its decisions, including any such scheme to the LG. To allow him to examine it and take a call.

The bench said that the final decision will rest with the LG as well as the council of ministers and the council of ministers will have to act in accordance with it.
