DISQUALIFYING CANDIDATES FOR WEARING GLASSES IS VIOLATION OF ARTICLE 14 - MADRAS HC

The Madras High Court comprising Justice MM Sundresh and Justice S Ananthi ruled that a person cannot be disqualified from a job on the account of being bespectacled, having a poor vision without glasses. Especially when the job description did not mention the criteria about good visuals. Disqualifying anybody from a job being bespectacled when the job can be done by wearing glasses is a violation of Article 14. 

 

The bench ruled this after a group of candidates were disqualified from being appointed for the post of sub-inspector because of poor vision. The bench faulted the disqualification stating that the candidates cleared the written, oral as well as physical test before being disqualified on failure to clear the visual test without their glasses.

 The court directed the appointment of the candidates within 6 weeks.
