Eid-e-Milad-un-Nabi Processions: Bombay HC Walks Fine Line Between Tradition And Noise
On Wednesday, the Bombay High Court resolved a plea that called for the state's Eid-e-Milad-un-Nabi processions to be held without the use of DJ sound systems or laser lights.
On behalf of petitioner Zuber Ahmad Nazir Ahmad Peerzade and others, advocate Owais Pechkar clarified that the processions commemorate three occasions: the birth of Prophet Mohammed, the day he was declared to be the prophet, and the day he also died away.
The petitioners claim that neither the Prophet nor his followers observed his birthday during his lifetime and that it should continue to be a solemn occasion. Chief Justice D.K. Upadhyaya and Justice Amit Borkar's bench, however, ruled, "Kindly argue on legal grounds."
What's the harm in employing laser lights and D.J.? We have no interest in hearing personal viewpoints. There exist opinions about DJs. So dispute over laser lights. Is there any empirical research demonstrating the deleterious impacts of laser light on any Indian or international institutions?"
Pechkar stated that there was a film featuring a scientist discussing the negative effects of laser lights and that there was not much time for the same."
But the bench questioned, why didn't you conduct your own research? Regarding cell towers, there have been a lot of protests. Have you completed any coursework? In the absence of a study demonstrating the negative consequences of laser beams, how do we make decisions? You ought to support the court in issuing directives that are practical. We are not specialists. I'm not familiar with L of laser," the bench stated.
The bench emphasised, "Go really into your study. It would have been better if you called some scientists and brought some research supplies. You have been given a week to conduct research since your previous mention of the petition."
Regarding DJs, the High Court panel stated that if these sound systems are bad for Ganesh Chaturthi, they are likewise bad for Eid and have already been outlawed.
