FED UP SEEING COPY-PASTE ORDERS OF HC - JUSTICE DY CHANDRACHUD

Justice DY Chandrachud made these remarks during the hearing of Union public service commission SLP arising out of Orissa High Court that upheld the CAT order. The issue in the case was whether a person could be denied a place in the Indian Administrative Service (IAS) on account of a disciplinary penalty imposed on him in 2011.
The bench held Article 320 will be applicable in this instant case, not DOPT guidelines. The Apex Court further stated that “Cutting and pasting judgments from tribunals will only add to the volume of the pages but does not explain the core issues''. The Orissa HC extracted judgments from the tribunals and only observed that the tribunals discussed elaborately on the law. The High Court has failed to apply its mind independently in the case.
