HC SET ASIDE THE ACQUITTAL OF 3  MURDER ACCUSED

The Uttarakhand High Court has set aside the order of the trial court, wherein the trial court has granted the acquittal to three accused and sentenced them for a period of one year and six months. The Court has held that because the accused is deaf and dumb does not make him innocent.

This is an appeal filed by the State wherein the three accused were charged and were also subjected to trial for an offence under Section 304 (read with Section 34 of IPC) by the trial court.

The division bench has concluded that the trial court's observation regarding the recovery being doubtful is totally baseless. Merely because the accused is deaf and dumb does not constitute him innocent or doubt the recovery.
