IT HAS BECOME A TREND TO FILE FALSE SEXUAL HARASSMENT COMPLAINT - DELHI HC

The Delhi HC said that it had become a trend to file false complaints to either arm-twist a party or force a party to withdraw the complaints. The HC further said that strict action would be taken against a person who will file false complaints u/s 354, 354B, 353D, 354C, and a fine of Rs 30,000 will be charged. Offences u/s 354, 354A, 354B, 353D of the IPC are serious offences; such allegations may tarnish the person’s image against whom such allegations are made. Such an act is an abuse of the process of law.
The Court passed the order in a petition regarding quashing of FIRs filed by both the parties. The parties submitted that after the intervention of common friends, relatives and family members had settled the issue orally, and a settlement has been reached. Therefore, the parties requested to quash the FIRs.
Allowing the mutual settlement, the court imposed 30,000 on both the parties and warned them not to file such false and frivolous cases. The instant case was a classic example of how parties have levelled false allegations.
