Court: Union of India v. Sanjay Jain
Recently, the Supreme Court dismissed the appeal filed by the National Investigation Agency (NIA) against Jharkhand High Court's bail order in an Unlawful Activities Prevention Act (UAPA) case.
Background
The respondent was accused of collecting extortion money for Tritiya Prastuti Committee, a Maoist splinter group. Three years after he was first taken into custody, the HC granted him bail in December 2021. The HC granted bail due to the lack of incriminating evidence against the accused as well as the fact that the trial had begun, the charge sheet had been filed, and the accused cooperated throughout the investigation.
Prima facie, the HC had observed that the offences under UAPA were not made out merely because he paid the amounts demanded.
Therefore, the NIA moved the top court against the bail order.
Held
While upholding the order passed by the Jharkhand HC, Chief Justice of India NV Ramana orally remarked, "The way you are moving ahead, it seems like you have a problem with not only journalists but also those who read the newspaper." This statement came after Additional Solicitor General SV Raju kept pressing for the bail to be cancelled by stating that the respondent collected funds for a terrorist group.
