KERALA HIGH COURT REJECTS THE PETITION FILED BY STATE ELECTRICITY BOARD

The Kerala High Court has dismissed the writ petition filed by the Kerala State Electricity Board (KSEB) for unfair electricity distribution by the Central Electricity Regulatory Commission Regulations, 2020. It has been contended that the regulations operated unfairly against electricity distribution licensees in the south zone.

A Single Judge Bench of the Hon’ble High Court passed this judgment while observing that the network gains relevance where an electricity consumer and the power generating company are located in different states.

The petitioner submitted before the high court that the National Electricity Policy and the Tariff Policy can be formulated only by the Central Government in consultation with the State Governments and the CEA. The Petitioner also submitted that subsequent revision to the said policy could also be only at the instance of the central government. The CERC has no role in the formulation of the National Electricity Policy and the Tariff Policy
