Earlier this week, the Madhya Pradesh High Court expunged its recent comments that a rape convict was "kind enough" to leave the survivor alive without killing her.
On October 18, a bench of Justices Subodh Abhyankar and Satyendra Kumar Singh reduced the life sentence of a rape convict to 20 years in jail after observing that he left the prosecutrix alive.
After a lot of controversies over the judgment and the statement. On October 27, the bench suo motu decided to alter the order by removing the observation about the convict's kindness.
This was an inadvertent mistake, according to the Court, as the October 18 judgment itself had noted that the appellant's act was demonic at another place.
The bench, therefore, modified the order to read as follows:
In light of the fact that he did not cause any other physical harm to the victim, this court reduces the life sentence to 20 years of rigorous imprisonment."
In the October 18 ruling, the appellant Ramu @ Ramsingh was convicted for rape a girl under the age of twelve under the Indian Penal Code by the Additional Sessions Judge, Indore. The appeal was filed by Ramu @ Ramsingh against conviction.
To conclude that the appellant's guilt had been proven beyond a reasonable doubt, the Court relied heavily on the evidence of prosecution witnesses and the medical report from the doctor who examined the victim.
However, it had reduced the sentence to 20 years jail term from life imprisonment because the appellant had not killed the girl.
