Madras HC has temporarily restrained DigiPe from using its logo after a trademark infringement suit filed by PhonePe
Following a trademark infringement suit filed by PhonePe, the Madras High Court has temporarily restrained DigiPe from using its logo.
As part of an interim order passed on December 23 last year, Justice C Sarvanan restrained DigiPe from using its logo for four weeks.
PhonePe has been providing UPI services since 2016 and possesses the trademark registration for "DIGIPE," whereas DigiPe applied for trademark registration only on September 26, 2022.
Additionally, the Court noted that DigiPe initially agreed to resolve the issue of alleged trademark infringement by PhonePe. Nevertheless, it filed a registration application for "the offending mark DIGIPE," according to the order.
In addition, since DigiPe had not yet begun its UPI services, the balance of convenience favored PhonePe.
Following a trademark infringement suit filed by PhonePe last year, the Court temporarily restrained MobilePe and its group companies from offering Unified Payments Interface (UPI) and Bharat Interface for Money (BHIM) services.
