MADRAS HC RESTRAINS SPECIAL PUBLIC PROSECUTOR FROM FUNCTIONING

The Madras High Court passed an interim order restraining a Special Public Prosecutor (SPP) P Seetharaman from acting as Special Public Prosecutor in NDPS cases until further orders. The order was passed noting that a Public Prosecutor should be unbiased, fair, and honest and should help the Court in giving justice. The Bench of Justice N. Kirubakaran and Justice B. Pugalendhi passed this order while considering the fact that Special Public Prosecutor P. Seetharaman did not file closing reports in 43 NDPS/Drugs cases which enabled the suspect in those cases to obtain legal bails.
The court said, "Even after appearing before this Court and giving undertaking before this Court that he will ensure that he will file the final report that were not filed in 43 cases and statutory bails have been obtained by the accused and (they) merrily walked away from jail."
