Advocate Vijay Singh Yadav got arrested on February 9th after congratulating the Judicial Magistrate First Class on her birthday on January 28th via e-mail and later through a speed post. An FIR was filed against the advocate at Ratlam’s Police station based on the complaint by Mahindra Singh Chouhan (District court system officer) under the charges of cheating, forgery, and dishonesty - sections 420, 468, and 469 of the Indian Penal Code and u/s 41 r/w 67 of the Information technology Act, 2000

It has been alleged that Yadav downloaded an image of the Judge (Mithali Pathak) from her Facebook Account without her consent and attached that picture along with a birthday card. This act of Adv Yadav might attract provisions of the IT Act since he was not added as a friend in the judge’s Facebook account.

Earlier, on 13th February, his bail plea was rejected by the lower court. Following this, Yadav approached the Indore bench of  Madhya Pradesh High Court. In the bail plea, Yadav stated that he had no intention to deteriorate the image or reputation of the Judge and that he obtained the photo Image from google and used it as a creative design. Yadav also said that he does not have the proper knowledge to access the internet and social media.
