A Bench of Chief Justice Sanjay Karol and Justice S Kumar stated in its order of the Patna High Court said that mental health was the lowest priority of the State government. "It appears that mental health of a person more so during the time of Covid-19, is the least priority of the State Government."

 

The Court was hearing a PIL seeking the establishment of a functional State Mental Health Authority as per the Mental Healthcare Act, 2017. The plea also sought a direction to spread awareness by providing information on mental health and COVID-19, anxiety and depression.

 

The State submitted no authority had been constituted yet and only an advertisement had been published in newspapers in 2020. The applications that had been received pursuant to the advertisements in the newspaper were under consideration. 

 

The Court showed disappointment towards the State and opined that the arguments by the State were vague. “What is that stage? How long would it take to complete? Who all are engaged in the selection process?" It was stressed that all departments of the State have become operational despite the pandemic.

 

The Court directed the Chief Secretary of Bihar to take steps to ensure the establishment of the authority, and to file an affidavit of compliance, before February 25.
