PETITION FOR BIASED LISTING BEFORE SC WAS DISMISSED

14th DECEMBER 2020

The Supreme Court dismissed the plea filed by Maharashtra Judicial Magistrate alleging unprofessional activities by the Supreme Court’s Registry regarding unequal treatment to him and the common man in terms of listings.

A three-judge bench of Chief Justice S.A. Bobde, Justices A.S. Bopanna, and V. Ramasubramanian heard the petition accusing the Registry of alleging that by pointing unnecessary defects and alleging discrimination.

According to the contention of the petition, the petitioner had filed a writ petition in February 2016 seeking reconsideration of the judgment in the case of “All India Judges Association Vs. Union of India & Ors (2002)” and following the amendment to the Maharashtra Judicial Service Rules, 2008. Thereafter the review was also dismissed on August 5, and the Curative Petition was filed on the same day. When the Registry pointed out some defects, the petitioner removed all the defects on the very same day. However, even after removing the defects and constantly asking the Registry to register the petition, the same was not done.
