Case: Manohar Lal Sharma vs Union of India

 

A public interest litigation (PIL) petition has been filed before the Apex Court challenging the constitutional validity of the Agnipath scheme, which proposes to enlist youth for four years in the army. 

 

The petitioner, advocate ML Sharma, prayed for quashing the notification issued by the Ministry of Defence announcing the scheme. According to the plea, under the Agniveer scheme, only 25 percent of the selected candidates will be allowed to continue in the Indian Army after four years, while the rest will be retired or denied employment. The candidates will be paid a salary but no pension, etc.

 

Sharma argued that the scheme was imposed on the country without the approval of the parliament and without a gazette notification.
