PRESS HAS RIGHT TO PUBLISH NEWS ITEMS WITH ITS NECESSARY COMMENTS AND VIEWS

The Kerala High Court has rejected the defamation case against the Chief Editor, Managing Editor, and Publisher of Manorma Daily.  The Kerala High Court Bench of Justice P. Somrajan observed that the press could publish a news article with its necessary comments and views. Such rights cannot be taken away unless malafide writ large on its face and not concerning with a matter of public interest.

The bench said, “The fourth estate must publish all news materials, especially having public importance, and it is their further duty to comment on the news material with its pros and cons to enlighten the society to remain vigil on the matters of public importance.”
