PROBLEM TO PROVE 'FAIR EVALUATION' CAN'T BE SHIFTED ON EXAMINING BODY UNLESS CANDIDATE PRODUCES ANSWER SCRIPT TO PROVE DISCREPANCY IN MARKING

 A single bench of Justice Yashwant Varma of Allahabad High Court in a writ petition filed by Manoj Kumar Tiwari, demanding re-evaluation of his answer paper for a particular subject in the entrance exam conducted for admissions to D.EL.E.D. course. The court said, "The practice of approaching the Court directly without obtaining copies of the answer paper or demanding directions requiring examining bodies to produce answer books cannot but be deprecated in the strongest terms, discouraged and restricted,"

After being unsuccessful at the entrance exam, he had appeared before the Court for the revaluation. The court remarked that "The conduct of examinations by educational authorities cannot be lightly interfered with unless the petition rests on a strong foundation and it is at least prima facie established that there has been an apparent and evident mistake in the process of evaluation."
