Recently, an SC bench issued direction to MACT, i.e. Motor Accident Claim's Tribunal, insurance companies, and police, to smoothen out MACT procedures and claimant friendly while hearing Bajaj Allianz General insurance petition.

The following directions are issued by the Hon'ble Court:

  1. Accidental Information Report: The police station shall report an accident u/s 158 (6) to the tribunal and insurer within 48 hours over email or website;
  2. The police will collect a detailed report of the accident, compute the compensation, and shall verify information of those documents.
  3. Summon shall be issued by the tribunals along with the report or compensation application to the insurer by email.
  4. After passing an award, the authentic copy of the award shall be emailed to the insurer.
  5. The insurer shall deposit the awarded amount in the bank account maintained by the tribunal; the tribunal shall maintain and record relevant bank details.
  6. Each tribunal shall create an email ID peculiar to its jurisdiction for receiving emails from the police and insurers, and the insurer will do the same.
  7. Insurer companies shall appoint a Nodal officer for each tribunal and provide relevant details to the director-general of state police.

These Directions should be applied across the country.
