A Thane court recently denied anticipatory bail to a 32-year-old man who misled his wife by concealing his homosexuality from her. Additional Sessions Judge RS Gupta observed that the man fraudulently cheated on his wife. 

"Every individual has the dignity to live in the society and no one else can interfere in lifestyle but that does not mean that a person gets the liberty to spoil the life of the other spouse." 

 

The two met on social networking and married in November 2021. The complainant stated that after marriage, she eventually discovered his sexuality and after seeing his contents on the phone, along with WhatsApp chat, it was proved that he had sexual relationships with two other males.

 

According to the complainant's lawyer, the accused forged a job offer letter stating that he would be paid ₹19 lakh a year. Prosecutor VA Kulkarni and Kadam argued that before the marriage, the accused concealed his homosexuality, cheating and ruining the plaintiff's life. The accused was only interested in the financial assistance of the complainant. 

 

The Court rejected the anticipatory bail application by stating, "It is not only the financial loss that the girl suffered, but her life has been also spoiled. If the applicant's sexuality has been openly shared before marriage then the consequence would be different."
