THE COMMITTEE TO EXPEDITE CASES UNDER 138 OF THE NI ACT WILL BE HEADED BY FORMER JUSTICE RC CHAVAN

The Apex Court bench comprising CJI SA Bobde, Justice AS Bopanna, Justice L Nageswara Rao and Justice Ravindra Bhat granted Solicitor General Tushar Mehta time till 12th march to suggest names to constitute a committee to devise steps for expediting disposal of cases u/s 138 of the NI act while hearing a suo moto case initiated by it regarding measures to expedite cases under 138 of the NI act. The court found that over 35 lakh Cheque bounce cases were pending before various courts across the county.

The committee will be headed by Justice RC Chavan (former Bombay High Court Judge) and other members of the committee as per the order:

• An officer from the department of justice,
• An officer from the Department of finance (not below the rank of additional secretary),
• An officer from the department of corporate affairs,
• An officer from the department of expenditure,
• Member nominated by the Governor of RBI.
• A member from the ministry of home affairs,
• Member nominated by the IBA chairman.

The committee will have to present the report to the court within 3 months.
