THE HIGH COURT DISMISSED PLEAS OF A MAN SEEKING A POSITION IN THE INDIAN AIRFORCE
The High Court dismissed the appeal of a man enrolling for the position of Airman in the Indian Airforce. He challenged the medical board's decision assessing him as unfit for the services on the grounds of overweight, unable to squat, & suffering from hyperbilirubinemia.
The criteria for the weight as mentioned in the Manual of Medical Examination & Medical Boards for the height of the petitioner (178 cm & 19 years) was 63 kgs with a margin of 6.3 kgs. However, as per the Medical Board's record and the Appeal Medical Board, the recorded weight of the petitioner was 83 kgs & 80 kgs, respectively.
The court waived the petition as one ground is enough for dismissing the petition.
''Suffice it to say that the petitioner, without imputing any malafide to the Officers constituting the Medical Board/Appeal Medical Board, cannot controvert their findings as to having weighed the petitioner''. Said the Hight court while rejecting the plea.
