The Kerala judge who gave a controversial order that sexual harassment cases could not stand if the victim wore a "sexually provocative dress" has been transferred. Additional District and Sessions Judge, Kozhikode S Krishnakumar, has been transferred as Presiding Officer of Labour Court in Kollam district.

 

Notice of the same was published on the website of the Kerala High Court. As per the notice, the transfer is part of the routine transfer and three other judges have also been transferred.

 

While granting bail to activist Civic Chandran in a sexual harassment case, Session Court judge S Krishna Kumar ruled that unwelcome sexual advances were necessary for the offense to be committed under Section 354A of the Indian Penal Code. However, photographs showed the complainant "exposing herself in provocative dresses" in the instant case.

 

In February 2020, at 5 p.m., a cultural camp was organized by a group called "Nilanadatham" in Kadal veedu at Nandi beach. After the function, the accused forcefully embraced the defacto complainant and asked her to sit on his lap as she rested near the seashore. The accused also pressed the woman's breast, outraging her modesty.

 

The order of the Sessions Judge had led to outrage within the legal fraternity itself.
