UNFORTUNATELY, THERE IS NO PROVISION SUCH AS DOMESTIC VIOLENCE ACT WHERE A HUSBAND CAN PROCEED AGAINST HIS WIFE - MADRAS HC
The Madras HC was dealing with a matter where the petitioner sought reinstatement to his job after being suspended from his job due to a complaint lodged by his wife under the Domestic Violence Act. The court noted that the petitioner moved to family court for divorce, days before the verdict, the wife filed a domestic violence complaint against the petitioner. It was alleged that the woman who filed such a complaint only harass the husband.
Moreover, the wife also failed to appear before the HC in the present petition, despite serving notice.
Justice Vaidyanath expressed concern that there is no provision like the Domestic Violence Act to proceed against the wife by the husband. The Hon'ble Court ordered the reinstatement of the petitioner to his job within 15 days. The court further added that the appropriate forum should decide the question of domestic violence. Meanwhile, there is no solid reason to keep the petitioner away from his work.
