In a resolution passed on Monday by the Bombay Bar Association (BBA), the BBA asked the concerned authorities to take action against Rashid Khan Pathan, who wrote to President Draupadi Murmu and CJI UU Lalit alleging allegations against Justice DY Chandrachud of the Supreme Court. Senior Advocate Nitin Thakker, heading the Standing Committee of the Association, requested to take strict action against Pathan.

The BBA further said Pathan's allegations were false, malicious and baseless. The resolution also noted that Pathan was convicted of contempt of court by the Top Court in 2019. Nevertheless, the resolution said that Pathan continued to make allegations against judges to intimidate the judiciary and interfere with the administration of justice.

The complaint against Justice Chandrachud had the following allegations:

  1. His son Dr Abhinav Chandrachud appeared before the Bombay High Court in a case in which Justice Chandrachud passed an order.

The BBA in the resolution specified that Abhinav practices as a counsel appearing in matters instructed by Advocates on Record, which meant he did not interact with clients directly. Moreover, the order by the SC is not even on merit.

  1. In specific orders, Justice Chandrachud rejected challenges to restrictions placed on people without vaccination. As per BBA, if judicial orders passed while discharging their duties as judges were attacked, it would amount to an attack on the judiciary itself.

Thus, the BBA strongly depreciated the attempt to undermine the judiciary and expressed their faith in Justice Chandrachud. The resolution also requested the President, Prime Minister, CJI Lalit and Central Vigilance Commission not to take any cognisance of the complaint.
