Earlier this week, Mohammed Ameerul Islam, a convict sentenced to death for the rape and murder of a Dalit law student in 2016, petitioned the Supreme Court to transfer him from Kerala to Assam.
According to the petition filed through Advocate Sriram Parakkat and Satheesh Mohanan, the convict's wife and aged parents, who live in Assam, cannot visit Islam in Viyyur prison in Kerala, where he is being held. It was argued that the petitioner has a fundamental human right to meet his family members.
Moreover, the plea stated that the convict had reached the Governor of Assam asking for his transfer to Assam, but the Governor had replied that Kerala had jurisdiction over him.
Background
On April 28, 2016, the mutilated body of a law student from Government Law College, Ernakulam, was discovered in Perumbavoor. The incident generated mass outrage amongst the student fraternity and human rights activists across Kerala. As the victim's family lamented their apparent ill-treatment by neighbours in the area, the case also acquired a casteist undertone. Online social media campaigns played a crucial role in mobilizing reactions.
A migrant worker from Assam, Ameerul, was eventually accused of having committed the crime after he broke into the victim's house in a drunken stupor the night before. In July 2016, Ameerul was arrested in Tamil Nadu.
The trial commenced in April 2016 and was concluded in December 2017. Ameerul was found guilty based on DNA evidence and testimonies by the witnesses. A judicial reference is pending before the Kerala High Court regarding the confirmation of his death sentence.
