A DELHI COURT FRAMED MURDER CHARGES AGAINST 4 MEN-RELYING ON AN EYE WITNESS - DELHI RIOTS
A Delhi Court framed murder and rioting charges against four men related to the 2020 Delhi Riots. The Court took the decision after relying on the testimony of an eyewitness who had witnessed a murder "through the gap in the wall."
Additional Sessions Judge Amitabh Rawat charged Anwar Hussain, Kasim, Shahrukh, and Khalid under Section 147 (rioting), 148 (rioting armed with a deadly weapon), Section 302 (murder), and 120B (criminal conspiracy) of the Indian Penal Code.
While passing the order, the Court noted that "the eyewitness gave a clear picture of how deceased Deepak was killed by the armed Muslim mob consisting of accused persons."
The four men were put on trial for allegedly killing Deepak during the February 2020 violence.
Counsel appearing for the accused persons argued that there is no CCTV footage of the incident involving the accused persons to date. Moreover, the FIR also did not name the accused persons.
The Court said that "By way of their mobilization and intention as inferred from their conduct, the unlawful assembly can be said to have conducted itself for riots and offenses like a murder of Deepak." "According to the witness, he hid behind a wall at a drain and witnessed the crime committed by the above-mentioned persons, and he also identified them by their name." And hence, the Court framed murder charges against the accused persons.
