In the present case, an appeal was filed by a Mumbai resident and his wife against the order of the Maintenance Tribunal. The order was passed by the Tribunal when an elderly couple ( father aged 90 years and mother aged 89 years ) had approached the court against the harassment by their son. It was alleged that the son and his family were occupying a flat in Mumbai against the wishes of the old parents. It was submitted that the father had gifted that property to his daughter still the son was living in it illegally. Despite many warnings, he didn't agree to vacate the flat leading to harassment and defeated the parents' right to a normal life. 

The Tribunal had ordered the son to vacate the flat immediately. 

Challenging the Tribunal's order, the son approached the Bombay High Court. Dismissing the appeal, the Court under the Senior Citizens Act, directed the son to vacate the elderly parents' flat within a month. 

The HC further remarked that the old parents suffering at the hands of the only son and daughter in law certainly shows some elements of truth in a popular saying that, "Daughters are daughters forever and sons are sons till they are married" surely leading to some exceptions.
