Bench: Justices Manmohan and Saurabh Banerjee

On Tuesday, the Delhi High Court asked the counsel representing Newslaundry to obtain instructions regarding whether they will delete videos related to India Today Group Vice-Chairperson Kallie Purie.

A Division Bench also instructed the Newslaundry counsel to obtain instructions for deleting the video in which some allegedly disparaging remarks were made against India Today reporters.

Newslaundry's programs, however, appeared to be part of 'fair comment' and did not appear to infringe copyright.

Indian Today Group and Newslaundry filed appeals against a single judge's order refusing to restrain the latter from making or publishing videos and articles that allegedly ridiculed, defamed, and infringed India Today's copyrighted content.

The Supreme Court had ruled that the right to free speech and expression includes the right to publish and circulate one's ideas, opinions, and views freely through electronic media and television channels, as well as through social media sites.

According to the bench, Newslaundry's comments were not strictly public interest, which demonstrates a prima facie case.

The matter will be heard on March 2023.
