DELHI HC WHILE DISMISSING A PLEA SEEKING SUSPENSION OF CONSTRUCTION AT THE CENTRAL VISTA SLAPPED A FINE OF RS. 1 LAKH
A Delhi HC bench comprising of Justice DN Patel and Justice Jyoti Singh dismissed a Plea
seeking suspension of construction at the Central Vista Avenue Redevelopment Project amid the second wave of Covid. The court rather gave a green signal to the Central Vista construction, saying it was an essential and vital project of the nation. The court further said that there is no question of suspending the work as the Labourers are already staying on site.
Moreover, here time is the key to the contract, the work had to be completed by November 2021 and therefore it should be allowed.
The Bench further remarked that the Apex Court already upheld the legality of the issue.
SG Tushar Mehta appearing for the centre argued that the plea is only concerned about
Central Vista and not about the workers. There is something unusual and it is beyond a PIL.
This PIL is a facade, created to disguise the project that they always wanted to stop in one
way or another. Public interest is very selective in few cases.
Adv Luthra appearing for the petitioner argued that the Central Vista project should be renamed to Central Fortress of Death.
The Delhi HC bench not only dismissed the petition but also slapped a cost of Rs 1 lakh on
the petitioner.
