MASK MANDATORY EVEN IF A PERSON IS DRIVING ALONE IN A PRIVATE VEHICLE - DELHI HC

The Delhi HC dismissed petitions challenging Delhi Government's decision to impose a challan or fine for not wearing a mask while driving alone. Justice Prathbia Singh ruled that it is mandatory to wear a mask while driving alone in a private vehicle during the Covid 19 Pandemic, which has infected more than 1.28 cr people in the Country.
The Court said that the mask is a SURAKSHA KAVACH that will protect the person wearing it and those around him. Wearing a mask is necessary whether a person is vaccinated or not.
The Petitioners contended that imposition of Challan or fine was arbitral and unjust as travelling alone cannot be constituted as a public place. The Delhi government referring to a judgement passed by SC in 2019, said that when a vehicle passes through a road, the public can reach the private vehicle. Thus, a private passenger vehicle such as a car shall be deemed to be a public place.
