MP HC DECLARED JUNIOR DOCTOR'S STRIKE AS ILLEGAL
The Madhya Pradesh HC declared the Junior Doctors Association strike as illegal. The court
remarked that the JUDA have chosen an improper time to lay their demands.
Facts
A petition filed by Shailendra Singh seeking direction to restrain members of “JUDA” of
Government Medical Colleges in the entire State of Madhya Pradesh and other Associations
or Unions of Doctors/Medical Officers/ Nurses/Medical Staff from continuing with the strike.
Counsel appearing for the doctors argued that few States have already raised the stipend up to Rs.85,000/- and therefore, the government should consider their demands. The second demand of JUDA is that they should be provided adequate security at the workplace as certain incidents of misbehaviour and beating by the family members of the patients in various government hospitals has been seen.
Court's order
We acknowledge and appreciate that they have suffered hardship and rendered duties
at the cost of their health. However, at the same time, they have indeed chosen an inappropriate time to press for their demands, howsoever reasonable they may be, by proceeding on strike. We direct them to immediately resume their duties.
