The Madhya Pradesh High Court, While rejecting a bail application, remarked that,

 "India is a conservative society and has not yet reached the level of civilization where unmarried girls, irrespective of their religion, indulge in Carnal activities with boys just for fun without any assurance of marriage".

 

The MP HC heard a bail application by an accused alleged to have committed rape on the Prosecutrix on the pretext of marriage. The counsel appearing for the applicant/accused said that the accused and Prosecutrix had a relationship for two years. The prosecutrix entered into a physical relationship with her own will as she reached the age of 21. It is a lie that the incident took place three years ago. It was further argued that the families of the accused and the prosecutrix opposed their marriage as the applicant is of Hindu Religion and the prosecutrix is of the Muslim religion. 

Hence, it cannot be argued that the applicant has committed rape on the pretext of marriage.

Counsel appearing for the state contended that the applicant Committed rape repeatedly since October 2018 on the pretext of marriage. He refused to marry the prosecutrix, and on 1st June, he informed that his marriage was fixed with someone else. Thereafter, the Prosecutrix tried committing suicide by consuming phenyl, but she survived.

Justice Subodh Abhyankar, while rejecting the bail application, said that,

"Boys getting into physical relationships should understand the results and should be ready to face the struggle just like the girl because the girl is usually the receiving end because she is at the risk of getting pregnant and ignominy in society if her relationship is disclosed. You cannot just plead consent on the part of the prosecutrix and laugh back home'.
