Senior Adv Vikas Pahwa, While seeking discharge in the criminal case of the death of Sunanda Pushkar, argued that the materials collected completely exonerates Shashi Tharoor (her husband and Congress leader).

BACKGROUND

Sunanda Pushkar was found dead in her suite of a luxury hotel on January 17, 2014, in New Delhi. Pushkar's husband, Shashi Tharoor, who is the sole accused in the case, is charged u/s 498 A, 306 and on alternative 302. As per the prosecution, Pushkar was a healthy person, and the cause of her death was poisoning due to consumption of Alprazolam. Pushkar was subjected to mental cruelty by her husband.

ARGUMENT

Adv Pahwa argued that Pushkar was not a healthy person; in 2014, she wasn't able to walk and was in a wheelchair. She had an autoimmune disease. Further, no complaints of mental cruelty were ever filed by any person against Tharoor. To date, there has been no opinion on Pushkar's death. Experts have failed to establish death as homicide or suicide.
