Justice Mukta Gupta of the Delhi High Court came down heavily on the Station House Officer of the Shamli Police, Uttar Pradesh for arresting two men related to a man who married a woman, against the wishes of her family.

The Court further criticized the SHO after being informed that the UP police arrested the two from Delhi without proper verification of the age of the woman. According to the First Information Report, the woman was found to be 21 years of age. The Court asked, Why no verification of the woman’s age was done? The men were taken away merely based on the statement of the woman’s family members?

The Court remarked, "Kya wo baaliq hai? Jo aapne kiya vo 100% illegal hai, padhiye 21 saal likha hai".

In August 2021, The Shamli Police arrested two men after a complaint from the family of the woman. Previously, the court issued a notice to UP police. A report from the Delhi police informed that UP police did not intimate the Delhi Police about the arrest of two men from Delhi. 

On questioning, the SHO replied that the two men were not arrested in Delhi prompting the Court to warn the UP police. "We will check the CCTV whether they were arrested from Delhi or not. Thereafter, I will order a departmental inquiry.” 

The Court further remarked, "Yahan Dilli me nahi chalega."

The Court directed the SHO to record the statement stating the age of the woman and present it before the local UP court so that the two men could be granted bail.
