The Orissa HC expressed its displeasure with the state government while hearing a plea by one Jambeswar Sahoo, who worked as an ad hoc employee for twenty years.

BACKGROUND

The Petitioner has been working as a Night watcher cum peon since 2001; earlier in 1990, he worked in the office of Child Development Project Officer as a peon.

He moved to the HC seeking regularisation of his services. His lawyer contended that he had been serving for more than 30 years temporarily, while a regular post of peon had remained vacant.

DECISION

The Court while considering other cases observed that the matter of taking out service from the petitioner for long 20 years temporarily in the presence of clear vacancy in the post of Peon amounts to exploitation of employees. It is here taking into consideration that there has been one vacant post in the position of Peon in the particular establishment, this Court directs to regularize the petitioner in the vacant post of Peon by completing the entire exercise within six weeks from the date of communication of the order.
