The Supreme Court comprising Justices Indira Banerjee and V Ramasubramanian and Bela M Trivedi refused a plea by Asram Bapu, who was seeking suspension of his sentence after Rajasthan HC denied his relief. The bench observed that crime by a godman is "no ordinary crime at all".

The Godman moved to the Apex Court seeking suspension of his sentence on the ground of his failing health and the urgency of availing ayurvedic treatment. Advocate Manish Singhvi appearing for Rajasthan, argued that the godman was given necessary treatment in jail.

BACKGROUND

Asaram was serving a life sentence at Jodhpur Central Jail in connection with a minor girl's rap. He first approached the HC for bail stating ill health and therefore need for Ayurvedic treatment. The convict tested positive on 5th May and also developed additional medical issues. The HC, however, refused to allow bail and directed jail administration to provide proper treatment.

Asram then approached the Top Court in appeal. The Top court heard the matter on 4th June and sought the response of the Rajasthan Government. The Rajasthan Government stated that Asaram was trying to change the place of his custody under the pretence of medical treatment.

In 2016, A committee of 7 doctors conducted tests and concluded that Bapu does not need any surgery. The State further stated that he already tried seeking suspension of his sentence twice before the Apex Court. It is just another attempt to suspend his sentence.
