2nd May 2021

A division bench of Delhi HC comprising Justices Rekha Palli and Vipin Singh directed the central government to allocate 490MT of oxygen to Delhi. The bench directed the government while hearing a petition raising issues on Covid 19 management and responsibility of allotment of oxygen tankers.

The bench said and noted that it is the central government's responsibility to arrange tankers, as Delhi is not an industrial state and has no cryogenic tankers; therefore, it could not facilitate the supply. To which the court further said that the allocation has been in force since 20th April and not for a single day the National Capital has received allocated supply.

The Court warned that the concerned officers of the Central Government should remain present during the hearing on 03.05.2021 if the order is not implemented. Looking at the situation, the court may even consider initiating Contempt Proceedings in case of non-compliance.

"Water has gone above the head. Now we mean business. Centre will arrange everything now. Enough is enough! ".

The Court noted that due to lack of oxygen for over one hour, Batra Hospital reported 8 deaths. The court also directed to collect data on admissions and discharge of Covid 19 patients in private and government hospitals.

The Court will hear the matter on Monday.
