Job advertisements that are not adequately circulated violate the fundamental rights of the candidates

The Allahabad HC held that if a job advertisement is not adequately circulated, it would violate the fundamental rights of the candidates as it would prevent a fair opportunity.
The order was passed while upholding an order passed by a single judge who dismissed the appellant's plea.
Mr Ravi Mishra, the appellant, was appointed as a clerk in a school. However, the District Inspector of Schools for approval refused his appointment on the grounds that the advertisement was published in a newspaper with a low circulation in the area. Mishra challenged the order before the HC.
The single-judge HC dismissed his plea on the ground that the advertisement was made in ‘Hindustan Kaa Swaroop’, which hardly had any circulation in the area.
The appellant claimed that the school management committee had advertised the vacant post in a local newspaper, and he was duly appointed.
The division bench of the HC found the appeal without merit and agreed with the reasoning of the single-judge.
