After the recent notable decision made by the Kerala HC on marital rape, A sessions court observed that the act of forcible Intercourse by a husband cannot be considered illegal.

The Bombay Court granted anticipatory bail to the husband accused of committing forced sexual Intercourse. The woman got married last year, immediately after the marriage, her husband and his family demanded money. A month after the wedding, the husband forced sex on the wife against her will. He again repeated it against her will when they went to Mahabaleshwar. After that, the wife complained of feeling unwell and went to consult a doctor. The doctor informed her that she suffered paralysis in her lower body.

The woman registered an FIR against her husband, who approached the sessions court for Anticipatory Bail. The Court said that it is unfortunate that the girl suffered paralysis; however, the applicant cannot be held responsible for the same.
